David’s Insolvency litigation practice and experience

David using his litigation and business know-how advises clients regarding claims brought by liquidators, Trustees in Bankruptcy and HMRC claims.

David has significant experience of defending such actions which can be brought and threatened by a liquidator in relation to alleged actions of the ex-directors. David has successfully defended and settled many claims brought against the ex-directors, their family members and business partners, as well as claims brought against suppliers and sub-contractors who had unknowingly provided services to the Company now in liquidation.

The liquidators powers in these situations arise mainly under the Insolvency Act, and sadly put an onus on the defendant to prove that there is has been no breach of the law. David can assist with these and to put the best legal case forward, as well as to advise the client on the best practical and tactical aspect of the case to suit the client’s particular circumstances in defending in Court of settling outside court.

David can also assist with similar claims brought by a Trustee in Bankruptcy or HMRC for unpaid tax.
