Who is David, and what services can he offer?
David is an experienced Solicitor Advocate & Partner at Simon Burn Solicitors with a successful litigation and corporate/commercial legal practice.
Background
David graduated with a Business degree, and worked for blue chip companies including British Airways and UBS Investment Bank starting in their Graduate Programme. After 6+ years in the City of London, David re-trained as a Solicitor with national firm, Eversheds, before moving to Sidley Austin, a US law firm specialising in all aspects of finance, combining his significant corporate and commercial experience with legal expertise for his clients.
Later, with a growing young family, David left London moving to specialist boutique law firm, Simon Burn Solicitors, to expand his practice into disputes/litigation.
Experience and Services
For 20+ years (with 16+ years at Simon Burn Solicitors so far), as a Solicitor Advocate and Partner, David has advised large and small businesses and their leaders, both in the UK and overseas, as well individuals and families in relation to the following areas of law:
Publication Disputes & Reputation Management
-Media/Publication Advice and Litigation for clients on Misuse of their Private Information, Defamation -libel and slander, Malicious Falsehood, and Harassment disputes, as well as providing reputation management, where necessary. David has litigated in the High Court, Court of Appeal and Supreme Court (see below), and is noted in the Legal 500 legal directory for his expertise in this area, and has been referred to as a “heavy hitting” lawyer.
David acts for both Claimants and Defendants as individuals, businesses and corporate clients based in the UK and overseas.
-Example instructions- David has advised in matters resulting in pre-action settlements, claims issued, defended and concluded in the High Court, plus appeals in the Court of Appeal and the first appeal in the Supreme Court addressing the Public Interest defence provided in Section 4 of the Defamation Act 2013 (https://davidmagill.co.uk/supreme-court-appeal/). David’s instructions and clients are varied including acting for high net worth individuals and family regarding misuse of private information following significant press interest and paparazzi harassment. Also securing a super-injunction to prevent the publication of an email to a large mailing list concerning our client’s very personal matters. Acting for multiple claimants against an NHS trust relating to radio interviews; acting for a claimant Polish émigré against a well-known Polish publication, acting for an ambulance driver in relation to publications online by multiple regional newspapers, and acting for a charity trustee and businessman concerning allegations and pictures published on Facebook by multiple defendants and which resulted in pre-action settlements including costs, damages and apologies.
Business and Company Advice and Litigation
David advises on contentious and non-contentious company/business matters including:
-General Commercial Advice and Dispute Management: Early advice for clients (owners/directors) on most commercial matters from simple disputes and risks through to advice on complicated and high value cross-boarder litigation. David can also provide advice and drafting/amending/reviewing contractual terms and settlement agreements, and handling negotiations and settlements.
-Banking/Finance documents and disputes relating to new and existing borrowing/lending and granting or action/defending enforcement of security including personal guarantees, third party security/ surety.
-Corporate and Partnership Disputes-Advising on partnership, shareholder and director disputes e.g. breaches of shareholder agreements and articles plus managing disputes arising from share sales and purchases, as well as deadlocks. David will also advise on and manage disputes arising from business and asset & share sales/purchases (including warranty disputes), advising on terms of shareholder agreements, articles of association, and disputes between shareholders and partners including negotiating settlements, share valuations and if necessary Court action including claims and/or petitioning the Court to “wind-up” a company or to resolve unfair prejudice of minority shareholder clients.
-Insolvency related litigation including defending claims brought by Liquidators, Trustees in Bankruptcy and HMRC.
